General
These are the General Terms and Conditions of L’Etablissement (‘LEtablissement.com’). Registered at the Chamber of Commerce in Amsterdam under the name LEtablissement.com, number 30269858 and VAT number NL 1504 69 111 B02. All offers, orders and agreements of LEtablissement.com are subject to these General Terms and Conditions, unless LEtablissement.com agrees in writing to other conditions. Agreed departures from the conditions shall not entitle the customer to any rights in respect of future transactions.....
The acceptance of an offer or placement of an order means that you accept these conditions. Departures from the provisions of these conditions are only possible if laid down in writing, in which case the other provisions shall continue to apply in full.
LEtablissement.com reserves the right to revise these Terms and Conditions. Users are responsible for keeping themselves updated with such changes.Agreements and Offers
An agreement shall only be established after acceptance of your order by LEtablissement.com. LEtablissement.com is entitled to refuse orders or to attach certain conditions to the delivery, unless specifically determined otherwise. In the event of not accepting an order, LEtablissement.com shall provide notice to that effect within two (2) business days of the order's receipt. The consequences of mistakes and errors made by the buyer shall be borne entirely by the buyer. If you wish to cancel the order, you can send an e-mail message to our Customer Service.
LEtablissement.com is entitled to use third parties in processing your order(s).
Offers from LEtablissement.com are non-binding. LEtablissement.com reserves the right to change prices, especially when necessary based on (legal) requirements.Prices
The listed prices are quoted in local currencies (including SEK, DKK, EUR, GBP and USD) for the products and services and are including local VAT unless otherwise specified, but do not include shipping costs. The total price listed on the order list and on the electronic order form does include shipping costs.
Are you ordering from a country outside the EU you may be subject of local taxes and import duties that are levied once the package reaches the specified destination. The price of the product is deducted from 19% VAT. Please contact your local customs office for further information. Any additional charges for customs clearance must be borne by you as we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country. Cross-border deliveries are subject to opening and inspection by customs authorities. Please note that this may delay shipment part because the goods are held up in customs duty. It is then your responsibility to contact the freight company and pay the damage costs.
Prices are subject to change at any time. Changes in prices do not affect the sum payable in a concluded sale and purchase agreement as confirmed by LEtablissement.com by e-mail. Although all information regarding prices, specifications, etc. is placed on the website with the utmost care, LEtablissement.com cannot guarantee its accuracy. LEtablissement.com shall not be bound to deliver any orders that were placed because of incorrect information that was displayed on the website.Payment
Immediately after placing an order, you will receive confirmation by e-mail stating the goods ordered, the delivery details and the total cost. Full payment shall always be made in advance: immediately and online by credit card (Euro card/Master card and American Express) or by iDEAL.
We collaborate with Buckaroo, a Dutch company for online payment solutions. All transactions are encrypted and 100% secured. Payment details are sent via an SSL (Secured Sockets Layer) connection, as internationally recommended for sending data securely over the Internet. LEtablissement.com will do her very best to deliver the package within the period indicated on the website. We are however dependent on our suppliers in this respect. As a result, all times indicated on the website are indicative only. A delay in delivery does not entitle the customer to compensation of any damages, or annulment of the contract or non-fulfilment of any obligation imposed on him from this or any other related agreement. The product should reach the customer within 30 days after shipping. If this does not happen, the customer can immediately undo the sale. This does not apply when parties have agreed another delivery term.
International orders are shipped with FEDEX. The goods cannot be left without a signature and the couriers usually operate between 08.00-18.00 (8am-6pm), business days. For shipping charges and time of delivery, please view LEtablissement.com shipping charge table.
Customers outside the European Union are exempt from 19 % Dutch VAT of the total amount. Please be aware of paying import duties and | or taxes, which are levied once your package reaches your country. We are unable to advise you about the exact amount of duties and taxes your package will incur as these charges are imposed directly by your local customs. You will be invoiced for the local taxes and duties by FeDex. As we are unable to advise the amount this may be, we recommend you to contact your local FeDex office to obtain a landed cost estimate. You have to count on approx 25 %.
For national shipment LEtablissement.com ships all orders to the address stated at the time of ordering through our delivery partners TNT Postal Service within with 1-2 working day of receiving payment. If we depart from this for any reason, you shall be notified by e-mail. We ship the order noted and insured. This means that the package is only delivered to you personally (and not at your neighbours’ address). Should you at the time of delivery not be at home, you can pick up your package at a post office near you.
Delivery in consignments is permitted. LEtablissement.com shall endeavour to keep the website as up to date as possible but a product may unfortunately no longer be available for delivery. In that case, LEtablissement.com shall contact you by e-mail as soon as possible.Returns Policy
We do our best to deliver a perfect product. Any complaints regarding the state in which goods have been delivered (including missing tags) must be made to LEtablissement.com no later than seven business days upon receipt of the goods by e-mail or telephone. We strongly advise all customers to check garments thoroughly upon delivery before removing any attached tags and before disposing of any original packaging. If your item is faulty on receipt, please contact us within 24 hours of delivery to arrange for an exchange or refund.
Should the article nevertheless not meet your expectations, you can submit a return within seven days after receipt of the order, on our website. If you, for whatever reason do not wish to keep the product, you may return within fourteen (14) days of delivery for a full refund. Please note that late returns (returning after 14 days) will not be accepted. The returned product must be in new, unused, unwashed and unworn condition with all the original packaging and garment tags still attached. New and unused means that there are no marks, no perfume scent on any item, any wear on the tags and no attempted reparations on a defect.
All shoes must be tried on a carpeted surface until you are certain you are keeping them. Shoes should be returned unmarked and in their original, undamaged shoebox as this is considered part of the product. Shoes that are returned without a box, in a damaged box or with scratched soles may not be accepted, and may be sent back to the customer.
LEtablissement.com reserves the right to reject the returns of goods that are not returned in accordance with our Returns Policy and we may request that you pay for the shipping of such goods back to you. If the returned goods comply with our Returns Policy we will refund the relevant part of the purchase price for that order as soon as possible and in any case within 3 business days after we receive your returned products. Our Returns Policy does not affect your statutory rights. Refunds will be done via credit card or directly to your bank account (by paying with IDEAL) depending on the way you paid originally. In both cases after retention of the charged original shipping costs.
If you wish to make an exchange to another product, you will be charged for the difference by credit card. If the product is cheaper, the difference will be put back into the account stated on the return form as soon as possible. Please note that we are only able to offer (size) exchanges of non final sale items. If you wish to exchange your final sale item, we suggest that you return it for a store credit and purchase the new piece in the size you want.
The return is to be reported to LEtablissement.com prior to shipping. You can do so on our website by emailing. The address to be used can be found on our website and is enclosed in every shipment you receive, together with clear and detailed return instructions. The costs of return shipping are for the client’s account. Please note that the item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods. We may not accept liability for goods that are not returned via our delivery service.
International customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU). LEtablissement.com will only pay the return shipping costs if the return is a result of our error.Complaints Policy
We welcome any remarks about our service, so that we can improve what we are doing. If you have reason to complain about our service, please email to our Customer Service stating clearly that you are making a complaint. Our aim is either giving responds to your complaint within a few working days or where necessary resolving the problem.Colours
Photographs and colours in the website may differ from the items’ actual colours. This depends partly on the colour settings of your computer and monitor.Liability
Liability of LEtablissement.com, its employees and the products of LEtablissement.com. for all damages of any kind, directly or indirectly, including loss of profits, consequential damage to movable or immovable property or to any person, is specifically excluded. LEtablissement.com. cannot be held liable for damage caused by the implementation of the agreement by third parties. LEtablissement.com accepts no liability for any damage arising from the use of LEtablissement.com products. LEtablissement.com.’s liability towards the purchaser shall be limited to the amount of the invoice that the purchaser under the agreement relating to LEtablissement.com. is due.
Unless there might be proof of intent or gross negligence of LEtablissement.com, LEtablissement.com isn’t liable for misunderstandings, mutilations, delays or not properly conveyed orders and notices as a result of the use of the Internet or any other means of communication in the communication between client and LEtablissement.com, or between LEtablissement.com and third parties, as it relates to the relationship between you and LEtablissement.com.Force majeure
In cases of Force Majeure, LEtablissement.com shall be entitled, at its opinion, to defer the execution of your order or terminate the agreement without judicial intervention, by notifying you in writing to that effect and without LEtablissement.com being obliged to any compensation, unless this would be unacceptable in the given circumstances, according to the criteria of reasonableness and fairness. Force majeure means any shortcoming that cannot be attributed to LEtablissement.com because it cannot be blamed and is not accountable pursuant to law, juristic acts, or common opinion. Under such circumstances, LEtablissement.com will do everything to solve the matter for the customer as soon and entirely as possible.Privacy
LEtablissement.com respects your privacy. All personal data disclosed to LEtablissement.com will only be used for completing the order and will never be made available to third parties. LEtablissement.com does not receive or store any credit card information on its computers and websites.Property Rights
LEtablissement.com and all content and compilation of such content included on LEtablissement.com, such as text, graphics, logos, button icons, images and software is the property of LEtablissement.com or its content suppliers. It is not permitted to make public, copy or store parts of the contents of LEtablissement.com without LEtablissement.com express written consent. Such consent is not required for personal non-commercial use.Applicable law and jurisdiction
Any dispute relating to a purchase and sale agreement to which these General Terms and Conditions apply shall exclusively be brought before the District Court of Amsterdam.
